This website is governed by the laws of Canada. GDPR and Prohibition of Use by European Residents — Royal LePage is headquartered in Canada, and its services are currently designed to facilitate real estate transactions in Canada. It does not knowingly or intentionally collect any personal data from residents of European Union countries or Switzerland, or from individuals protected by the European General Data Protection Regulation (the “GDPR”) (collectively, “European Residents”). Notwithstanding any other provision of this Privacy Policy, and because Royal LePage may not comply with the requirements of the GDPR, European residents are prohibited from using Royal LePage’s website(s) and Royal LePage products and services to the extent that the GDPR would apply to Royal LePage’s collection of personal data about European residents. Royal LePage may block European IP addresses and take other measures to ensure that it does not collect any personal data from European residents. If a European resident attempts to circumvent these measures (e.g., by using a virtual private network (VPN)) or otherwise violates this Privacy Policy or Royal LePage’s Terms of Use, that European resident agrees to hold Royal LePage harmless from any and all liability arising from his or her actions (including, but not limited to, with respect to fines imposed by European authorities on Royal LePage or its affiliates in accordance with the GDPR). If a European resident believes that his or her personal data has been transmitted to Royal LePage or wishes to verify that it has been transmitted, he or she may contact Royal LePage as set forth in the last section of this Privacy Policy. Royal LePage will immediately delete any personal data relating to European residents.

Royal LePage’s privacy policy is based on Canada’s Personal Information Protection and Electronic Documents Act (“PIPEDA”), which encompasses the ten principles set out in Canada’s Model Code for the Protection of Personal Information. At Royal LePage (“Royal LePage”), we respect the privacy of our customers and are committed to ensuring the accuracy, confidentiality, security and protection of your personal information. We have adopted the following Privacy Policy to ensure that Royal LePage is committed to respecting your privacy and the protection of your personal information.

APPLICATION OF THE TEN PRIVACY PRINCIPLES – HANDLING OF YOUR PERSONAL INFORMATION

Royal LePage wishes to maintain the highest standards by applying the ten privacy principles set out in Schedule 1 of thPersonal Information Protection and Electronic Documents Act (S.C. 2000,  ch.5)

In this regard, the following ten principles govern our actions with respect to the collection, use and disclosure of personal information:

Principle One – Accountability

Royal LePage is responsible for all personal information it holds or maintains, including personal information transferred to third parties for processing.

Principle Two – Identifying Purposes

Royal LePage will inform you of the purposes for which it collects personal information, before or during the collection of the information. 

Principle Three – Consent

In accordance with Canadian law, Royal LePage will obtain your consent before or at the time of collection, use or disclosure of your personal information.

This consent may be express or implied. In some cases, it may be given through an authorized representative. You may withdraw your consent at any time upon reasonable notice (subject to restrictions provided by law or a contract, of which you will be notified). Royal LePage may, however, collect, use or disclose personal information without your knowledge or consent in exceptional circumstances where the collection, use or disclosure is authorized or required by law.

Principle Four – Limiting Collection

The information collected by Royal LePage will be limited to the information necessary for the purposes identified to you or necessary to provide the requested services. This information will be collected in an honest and lawful manner.

Principle Five – Limiting Use, Disclosure and Retention

Personal information will not be used or disclosed for purposes other than those for which it was collected, unless you consent. Personal information will be treated in accordance with our records retention policies and will generally only be retained for as long as necessary to fulfill the purposes for which it was collected, unless applicable law requires or permits it to be retained for a longer period.

In exceptional circumstances, Royal LePage may have a legal obligation or right to collect, use or disclose personal information without your knowledge or consent for matters relating to the business or public interest.

Data will not be shared or sold to third parties for marketing or promotional purposes.

Principle Six – Accuracy

Royal LePage will ensure that personal information is kept as accurate, complete and up-to-date as necessary to fulfill the identified purposes. You will be able to change or supplement the information if you discover that it is inaccurate or incomplete.

Principle Seven – Security Measures

Personal information is subject to security safeguards appropriate to the level of importance.

Principle Eight – Transparency

Royal LePage will make available to its customers, employees and REALTORS® information about the policies and procedures that Royal LePage uses to manage personal information. You have access to this information through our websites or by other means upon request.

Principle Nine – Access

Upon written request, you will be provided with information about the existence, use and disclosure of your personal information, and you will be able to access this information, except where prohibited by law. Royal LePage will respond to these types of requests in the most efficient way possible. If Royal LePage is prohibited from providing access to personal information, Royal LePage will explain why access is not possible, except to the extent prohibited by law.

Principle Ten – Ability to Complain of Non-Compliance with the Principles

People have the right to voice their concerns about an organization’s compliance with these privacy principles. Royal LePage has established policies and practices for receiving, investigating, responding to, and responding to complaints and questions about this Privacy Policy and the collection, use and disclosure of personal information. You may contact Royal LePage to express your concerns about Royal LePage’s compliance with the Policy or to request access to your personal information. Contact information for our Chief Privacy Officer is provided at the end of this document.

Application of the Ten Privacy Principles – Handling of Your Personal Information

1. Type of Information Collected

Royal LePage collects a variety of information about you and your devices and uses that information, including your personal information, to provide you with the products and services you have requested and to comply with the requirements of applicable law. Some of this information directly identifies you (such as an email address), while others are associated with you using your account, profile, or device (such as the homes you choose to register or your location data). The following is a list of the information we collect:

  • information used to assess franchise applications from agents, brokers, brokerages and agencies;

  • information necessary to provide quality real estate professional services to clients and to ensure that you are satisfied with the products and services provided to you.

 

We do not collect any personal information about you when you visit the Website (other than your IP address, as described below in the “Website Usage Information and Cookies” section) unless you provide it. All information you provide to us is kept secure and kept strictly confidential. This Privacy Policy does not apply to aggregated data about individuals whose precise identity cannot be determined. Royal LePage reserves the right to use anonymized aggregated data as it sees fit.

2. Use of Your Information

At Royal LePage, we use personal information for the following purposes:

  • To verify your identity

  • To promote your property for sale or rent

  • To help you find a property for sale or rent

  • To communicate with you in order to provide you with our products and services, including to provide you with updates about our services and to offer you other products and services that may be of interest to you

  • To include them in the documentation relating to your particular real estate transaction

  • To monitor our level of service and follow up with you to ensure that you are satisfied with the delivery of the services

  • To review your application for employment or engagement as a Royal LePage agent

  • To communicate with you and others

 

We use the contact information you provide to us, such as your phone number and email address, to communicate with you about our services. This includes communications to respond to comments, questions, or requests you send to us, as well as updates on transactions or services and notices of changes. We may also send you information about our services, offers and promotions, as well as news and other updates that we think may be of interest to you.

We use the information we collect about you and your activities on our site to personalize the services we offer. We also use it to show you ads, content, or features that you may like. This includes personalized search results that match your previous preferences and search criteria and, if you ask us, connecting you with a real estate professional who will be able to assist you.

Other Possible Uses of Your Information:

  • Delivering and improving our services

 

We use your information to provide you with our services. We also use them to improve our current services and develop new ones. For example, we monitor your use of our websites and apps, and we use this information to troubleshoot issues and make changes to improve your experience.

If you ask us, we also use your information to connect you with real estate professionals, such as when you want to contact an agent to discuss a house for sale found on our platform.

  • We also use your information to detect, investigate and prevent fraudulent transactions and other illegal activities and to protect the rights and property of Royal LePage, its customers and third parties.

 

We will only use your personal information for the purposes identified to you and to which you have explicitly or implicitly consented, unless an applicable law requires or permits other use without your consent. If we wish to use your information for any other purpose, we will notify you and ask for your consent in advance.

From time to time, we may wish to use your information for a purpose other than as described herein. In such a case, we will inform you so that you can accept or not accept this employment.

iii. Website Usage Information, Location and Cookies

Royal LePage may collect information about your use of this website. For example, our web servers may automatically record certain information when you visit the website.

Information about the use of this website is collected using “cookies” (described below) and may include the pages you have visited, your Internet Protocol (IP) address, your home search history, the homes you look at, purchase transactions, items you click on, and other features used, the time you spend viewing different sections of our websites and other site usage statistics. This information is only used for research and analysis purposes (e.g., how many people visit our websites or which pages are visited most often). This aggregated data may be shared with third parties, but will never be accompanied by any personally identifiable information. When you communicate with us or a real estate professional from our platform, we collect data about your call or text, including the date and time of the call or text, your phone number, and the content of the call or text.

If location services are enabled on your mobile device, Royal LePage collects location data from your device. We use this information to provide you with information and listings, such as homes and real estate professionals in your area, and to offer services based on your location. If you don’t want to use these features, you can turn off location services on your device. We also collect location data for similar purposes from your browser if you enable this feature. You can disable access in your browser settings.

Cookies are small text files that contain a unique identification number that allows our computers to identify and collect data about your web browser or the model and settings of your device, operating system and the version of the application you are using (but not you) each time you visit our websites. We also collect data about how your browsers and devices interact with our services, including IP address, crash reports, system activity, and the date, time, and URL of the site you visited prior to our website. This information helps Royal LePage improve site functionality, navigation, and security during your session, and helps us serve you better by understanding what you are interested in, tracking trends, measuring ad effectiveness, saving your preferences, and storing data that you may want to retrieve on a regular basis.  such as your favorite homes. In addition, we allow specific authorized partners to collect data from your browser or device for advertising and measurement purposes using their own cookies or similar tools. Most major websites use this technology, and most browsers are programmed to accept them.

You can set your browser to notify you when you receive cookies, and you can reject them altogether. However, if you do not accept cookies, you may limit the functionality available when you visit our site.

If you use your social media credentials (such as Google and Facebook) to log in to Royal LePage, we may access your public social media profile information. You can always limit this sharing by adjusting the settings of your social media service.

4. Authorized Disclosure of Your Information

Royal LePage is obligated to keep your personal information confidential, except in the following circumstances:

  • When We Have Your Permission

 

Many of the services offered by Royal LePage require us to collect personal information about you in order to provide the services for which you have engaged us. For example, if we refer you to a Royal LePage agent, we will provide them with information about your property and contact information.

We will always obtain your prior consent and we will never use your information for purposes other than those of which you have been informed, unless an applicable law requires or permits other use without your consent.

You may withdraw your consent at any time upon reasonable notice (subject to any legal implications of which you are notified). In some cases, if you do not consent to the use or disclosure of certain personal information, we may not be able to continue to provide the requested services in whole or in part.

  • When required by law

 

The type of information we are legally required to disclose is usually related to government tax reporting and financial transaction monitoring requirements. However, in some cases, such as pursuant to a court order, we may be required to disclose certain information to the individuals named in the order. We will only provide the specific information that is requested and only if we are satisfied that the authorities have valid grounds to request it.

  • Where permitted by law

 

Canadian privacy laws provide for certain situations where Royal LePage is legally permitted to disclose personal information without your consent, such as in situations of debt collection, medical emergencies or suspected illegal activities.

Who We May Share Your Information With

  • Real Estate Brokers, Agents and Employees

 

In the course of our day-to-day business, we may disclose personal information to Royal LePage REALTORS®. For example, if we know that you work with a specific Royal LePage real estate agent, we may share information about the homes you have registered and your searches with that agent to enable them to serve you more effectively. Our employees will also have access to personal information. Access to personal information is restricted to brokers, agents and employees who have a legitimate reason to use it. As a condition of employment, all Royal LePage brokers, agents and employees are required to comply with all applicable laws and regulations, including this Privacy Policy. Any Royal LePage broker, agent or employee is prohibited from using or disclosing a client’s confidential information without authorization, subject to disciplinary action.

  • Royal LePage Third-Party Providers and Service Providers

 

We may engage and coordinate third-party providers for the provision of certain services offered through Royal LePage. These providers receive only the information they need to provide the specific services for which we engage them, and they are prohibited from using this information for any other purpose. Suppliers are obligated to protect the confidentiality of your personal information and to treat such information in accordance with this Privacy Policy.

  • Sale of the business

 

We may disclose your personal information to a third party and its professional advisors in connection with the sale, merger or transfer (whether of property, stock or otherwise) of our business. In this case, we will require that the information be kept confidential and used only to evaluate and complete the transaction.

5. Security Measures to Protect Information

Royal LePage has organizational, technical and physical controls in place to ensure the security of the information in its possession and that of the information systems. Files containing personal information are classified according to the sensitivity of the data. Our IT systems and data processing procedures have adequate controls in place (such as restricted access). Physical access to the premises where personal information is collected, processed or stored is restricted to authorized employees and contractors.

When you call a Royal LePage agent or employee to discuss your case, they may ask you to provide personal information in order to identify you. This type of security measure is designed to ensure that only you, or someone you have authorized, can access your file.

As an additional safeguard, we follow records retention practices consistent with trade practices and securely destroy your personal information once it has been used for its intended purpose, unless the law requires or permits it to be retained for a longer period.

6. Third-Party Websites

To better serve you, Royal LePage provides links to third-party and social media websites on its website to allow customers to view certain information about third-party products and services. Royal LePage assumes no responsibility or warranties with respect to the content or privacy policies of other websites linked to www.royallepage.ca.

vii. Access to Your Information and Changes

You have the right to access the personal information we maintain in your file and you have the right to verify or correct it if it is inaccurate or incomplete. If you wish to access the personal information in your file, please send a written request to the Chief Privacy Officer at the address provided below in the “Questions, Concerns and Complaints” section. We will respond to your request as efficiently as possible. Please note that we will ask you to provide personal information to verify your identity before granting you access to your file. Also be aware that the right of access is not absolute; We may deny you access in certain circumstances provided for by applicable law.

viii. Withdrawal of consent

If you wish to withdraw your consent to the collection, use or disclosure of your personal information, please contact the Chief Privacy Officer at the mailing address, telephone number or email address at the end of this document. Although we may comply with your request and stop sending you promotional materials, if you withdraw your consent to the collection, use or disclosure of your personal information for other business purposes, we may not be able to provide you with our services that require the use and disclosure of that information.

PROVINCE OF QUEBEC:

In addition to maintaining the above standards, Royal LePage is committed to its obligations under the laws applicable to the protection of privacy and personal information in the Province of Quebec.

1. INTRODUCTION

In Quebec and elsewhere, Royal LePage provides a variety of services to the public, including, but not limited to, real estate brokerage services, real estate agency services, advice on the purchase and sale of real estate, real estate leasing and property management, and other real estate advisory services.  including selling or recommending real estate-related services.

In the course of providing these services, Royal LePage may collect certain personal information about its customers, employees, and Royal LePage brokers and agents with the consent of the individual. Royal LePage may also collect, use or share information without prior consent where such collection, use or sharing is permitted or required by law.

For the purposes of the Act respecting the protection of personal information in the private sector, the term “personal information” is defined as “any information that relates to a natural person and that allows that person to be identified”. It may include, but is not limited to, the individual’s name, home address, email address, date of birth, credit history or other financial information, credit card information, and other family information.

Business contact information is also personal information, but consent is not required to collect, use or disclose this information for the purpose of communicating or facilitating communication with someone for a business purpose.

All of our employees and contractors who have access to personal information must adhere to Royal LePage’s Privacy Policy in accordance with applicable law and practices.

To this end, Royal LePage has designated a Chief Privacy Officer who is responsible for ensuring compliance with the policy by all Royal LePage employees and for answering your privacy questions.

2. POLICY OBJECTIVES AND SCOPE

The purpose of this Privacy Policy is to ensure Royal LePage’s compliance with the requirements of applicable laws and regulations in Quebec and respects the rights of all our customers or other individuals with respect to the collection, holding, use and disclosure and protection of personal information.

To this end, this policy provides a framework for the collection, use, retention and destruction of personal information in order to establish and maintain a relationship of trust between Royal LePage and its customers and other individuals and to comply with applicable laws.

3. CONSENT

In the course of providing its services and with your consent, Royal LePage and its partners use cookies or similar technologies, visit https://www.royallepage.ca/en/realestate/cookie-policy/. These methods allow us to collect and process personal data, including, but not limited to, your visits to our website, the collection of IP addresses and cookie identifiers. You will be asked to confirm your consent and under applicable laws, you may withdraw or limit your consent at any time.

4. COLLECTION, USE, SHARING, RETENTION PERIOD AND YOUR RIGHTS

In the course of our business and service delivery, we collect a number of personal information about you, such as:

  • identity information, such as a first or last name;

  • contact information, such as name, address, email address, and telephone number;

  • biographical information you submit, such as a job title, employer name, photos, and video or audio content;

  • information you provide to us in the course of providing our services, including sensitive personal information;

  • billing and financial information, such as a billing address, bank account information, or payment information;

  • general information, education and employment history, details of professional affiliations, and other information relevant to the services you wish to receive from us or in connection with an assignment you wish to entrust to us;

  • identification and other background check data, such as a copy of a driver’s license, passport, or utility bill;

  • any other personal information provided. Please note that if you provide us with personal information about third parties, you must ensure that you have given them due notice that you are providing us with their information and that you have obtained their consent to such disclosure. This is not the responsibility of Royal LePage;

 

We use your personal information for the sole purpose of providing you with our services and to meet our obligations with respect to the mandate you wish to entrust to us. We will retain personal information only for as long as necessary for the purposes set out in this Policy and to comply with our legal, ethical and regulatory obligations related to it. Please note that upon receipt of a withdrawal of your consent, we comply with the requirements of the Act in such situations.

In the performance of our services or in the conduct of a mandate entrusted to us, we may use personal information in any of the ways set out below, with your consent or, where applicable, without your consent where required or permitted by law. Information may be collected for example:

  • To provide our and other services and for the conduct of our business, to administer and perform our services, including to perform our obligations arising from any agreement entered into between you and us;

  • To ensure compliance with our legal and regulatory obligations;

  • To ensure the proper conduct of our business and to comply with our ethical and professional obligations, including invoicing, financial management and the management of our records;

  • For any other purpose that is permitted by law or for which you give your consent.

  • For statistical or quality control purposes;

 

In the course of providing services to us and/or in carrying out a mandate you entrust to us, we may be required to provide your personal information to our service providers, employees, contractors and partners.

For example, we may provide your information to third-party service providers and/or partners who provide website services, application development, hosting, maintenance and other services to us. However, please be assured that we limit the information we provide to these service providers to only that information that is reasonably necessary to enable them to perform their functions and we require them to expressly agree to maintain the confidentiality of such information.

In addition, we may be required to disclose personal information and other information under certain laws or if we believe in good faith that such disclosure is necessary to comply with applicable laws or to carry out a mandate entrusted to us. For example, identity information, identification and other background check data, and any other personal information provided, or in order to collaborate with government authorities.

 

From the time it is collected until it is destroyed, your personal information is currently hosted in Canada, but may be  hosted on secure servers that may be located in the United States if the nature of the service provides warrants. However, please be assured that our practices with respect to your personal information remain governed by this Privacy Policy at all times and, where applicable, contractual commitments to protect confidentiality are put in place to preserve the confidentiality of such information.

 

While we cannot guarantee absolute protection of all of your personal information, we take all necessary steps to ensure that the personal information we collect is protected and stored according to generally accepted industry standards, both at the time of transmission and once we receive it. We maintain appropriate physical, technical or administrative safeguards to protect personal information from theft, loss, destruction or accidental or unlawful disclosure, unauthorized disclosure or access, misuse or other unlawful processing of personal information in our possession.

Please be aware that you may contact us at any time to obtain more information about how your information is protected or to disclose a privacy incident to us in accordance with the “Contact Us” section of this website.

In accordance with applicable privacy laws, you have a number of rights with respect to your personal information. These rights include, but are not limited to:

  • The right to accuracy of information: so that it is complete, up-to-date and accurate at the time it is used.

  • The right to access information: the right to be informed about the information being processed and/or used and the right to request access to the personal information held, subject to applicable law.

  • The Right to Have Information Corrected: The right to request rectification of any incomplete, misleading or inaccurate personal information we hold.

  • The Right to Withdraw Consent to the Disclosure or Use of Personal Information Collected: You may withdraw your consent to the communication, transmission or use of the information collected at any time.

5. CONFIDENTIALITY INCIDENT

In accordance with applicable law, Royal LePage is committed to promptly reporting any situation that gives rise to the belief that “a confidentiality incident involving personal information under its control” has occurred and that poses a risk of serious harm.

In such a case, the person responsible for the protection of personal information designated by Royal LePage shall notify  the Commission d’accès à l’information established by section 103 of the Act respecting Access to documents held by public bodies and the Protection of personal information (chapter A-2.1)

Any confidentiality incident is recorded in the “Privacy Incident Log” established in accordance with the Act.

6. UPDATES

This policy is being updated to remain compliant with legislative requirements. Royal LePage invites you to consult the most recent version. After each update, we will assume that you are aware of the current version of our Privacy and Personal Information Protection Policy and that we may collect, use and disclose your personal information in accordance with the updated Privacy Policy, unless you notify you otherwise in writing.

7. COMPLAINT

Under the Act respecting the protection of personal information in the private sector, any interested person may, in good faith and without fear of reprisal, make a complaint to the Commission about any matter relating to the protection of personal information and about Royal LePage’s practices in this regard.
